street. police swarming in on protesters. someone spilled some type of paint on a card. it seems as though the police were trying to prevent the protesters from taking over a car. protesters marched from the library to -- we thought they were going to city hall, but they made a detour here through police headquarters. police are determined not to let them surround the police headquarters, and there are shots going off and there is a smell of a tear gas. i'm not sure what it was, it was not very flattering. thank you very much. a protester is helping me with my report. flash grenades going up and pretty much a chaotic scene. police have eighth and washington cordoned off. protesters are marching around the block. it's a very, very fluid right now. we saw one person being arrested. i don't know how many arrests have gone down so far. >> where do they want to go? do they tell you where they want to go, back towards city hall

where they were the last couple of weeks before being dismantled this morning? >> it sounds as if they did at the rally in front of the library. they said that they wanted to go back and take over city hall. what they feel is rightfully theirs, and they said they were going to head back to that location, but when they started marching about 1,000 strong, they headed down to madison street. thought they were going down to city hall but they are going towards the police department. their anger is towards the police department, and i do believe they are angry about what happened earlier today, and it seemed to be calming down just a bit but it's definitely a fluid situation. >> let's talk about the nature of the protesters. some of the same people that were parked out in front of the plaza for the last ten days or so, or is this a mix of other people that we've seen protesting in the past on the streets of oakland? >> definitely some of the same faces who were occupied outside of city hall, but there are a

few more people coming in from different places. when i see some different people i try to talk with them and engage them and see where they are from and why they are here, and they say they are here for the movement. they are here because of corporate greed. there are some other people who are here for those reasons. right now it looks like there's a gathering at eighth and washington. that seems to be the situation there. some protesters are sitting in the middle of the streets. the police don't want that at all. probably can't see from the chopper, but police are in riot gear. they are here in full force, and we're just watching what's going on. >> tell us a little bit more about the numbers of the police. what are we talking about in terms of numbers that you can see and the position that you think police are taking at this point. >> oh, jess characters as i said, i'm right in the middle of, it and i'm seeing police in rooitd gear. they are coming my way. i see 20 right before me. the protesters were coming their way, and it looks as though they are letting them march, but they

want them to do it in a peaceful way. it seems though the police moved when n when the protests surrounded a car, and that's when they moved in quickly with some force, but it's just like the protesters are marching down washington street, heading towards the police station. the police officers are backing up their batons and their riot gear and protesters are moving forward so i don't know how to explain it. it seems as though they are allowing them to -- to march in a peaceful way, just as long as they are peaceful. it seems like the police will facilitate what's going on here. >> sheryl, you've been following this every step of the way. this is obviously becoming a national story. has it been peaceful? you seeing a sense of the mood changing just in the last hour you've been on the ground from changing to a peaceful occupy protest to any sort of flash points? >> it has been peaceful, as i look here on the corner. i see a dumpster turned over. before now it has been peaceful. it has had little skirmishes

here and there. there's an announcement going on right now. they are telling them to disperse. they are saying it's the oakland police department. i don't know if you can hear it, and they are declaring this an illegal assembly so they are trying to keep control of it. it has been peaceful as you were marching down the streets from the library towards the police department. people, the marchers had peace signs held up high so i think the majority of the occupy movement folks want to hold a peaceful protest, but when something happens that the protesters don't want, you just don't know what's going to happen. >> sheryl, we'll let you go in a second. one more final question before you do some of your work there. have you heard from interim police chief jordan or mayor quan about what they feel is the status of this and whether the protesters will be eventually allowed back to the plaza which is exactly what they are asking for? >> well, i can tell you that

mayor quan is out of town. i believe she's in washington, d.c., and she released a statement. as far as the police chief is concerned, he's keeping mum as far as what the next steps will be, but we gave them a warning, we gave them a week's warning and there was unlawful assembly from the city hall, and he's trying to protect the rights of the everyday folks walking up and down the streets at city hall in oakland, so he's kick back and giving orders. the police department is right now saying it's unlawful assembly, saying that they are subject to arrest. this is going to be an ongoing situation, i'm sure, through the night. >> we'll let you continue to monitor the protesters on the ground there. >> that's cheryl hurd from eighth and washington from downtown washington. you're watching our nbc chopper above the scene. presumably many of the occupy protesters dismantled from the camp this morning are back and wanting to return back towards oakland city hall. 80 people were arrested this

morning let's shift towards city hall and bring in nbc bay area's jodi hernandez. i assume they will be coming to you within the next 10 to 20 minutes. what's the scene there and what exactly set all of this up this morning to get all of this rolling today? >> reporter: raj, we thought protesters were heading over here to the plaza. if they had made it this way, and if they do make it this way, this is what they are going to encounter, dozens of police officers. like i say, people honking their horns, dozens of police officers in riot gear. you can see this plaza is barricaded off. meanwhile, inside the plaza itself, the cleanup is well under way. haz-mat teams are there as we speak. as the city put its foot down this morning and decided to kick the campers out early this morning. after camping in tents for more than two weeks, occupy oakland demonstrators got a rude awakening early this morning as

several hundred police dressed in riot gear cleared campers out. >> i have an obligation and a responsibility to uphold public health and safety. i could not do that under these circumstances, and i made the decision, with the team that was in place, to -- to put an end to -- to what i see as a very -- a very critical situation that posed significant risk. >> in the end i think we allow people to exercise their freedom of speech, right to assemble. they will be given that right again, but we want to make sure that the message is clear that the city is not going to allow overnight lodging or camping any longer. >> reporter: as the dust settled, we got a chance to tour the aftermath before haz-mat teams went to work. we are told needles, feces, bed bugs and lice littered the plaza, but demonstrators say that's the city's spin on thing. they say the camp was a community with a purpose. >> we built a garden and had a kid zone and medics and had like

this 24-hour free kitchen, and all this stuff that we worked so hard to make. it's just destruction, like everything is flattened. everything is destroyed, and -- and just it was insane. >> reporter: demonstrators called this morning's takedown excessive, and they say they won't be kept away for long. >> we're going to come back. they can't get rid of us there easily. >> this won't go away because the necessity for it won't go away. this won't go away because every month and every year, every fiscal year, there will be more these individuals in the same position that many of us are, having experienced homelessness, unemployment and even having our education curtailed. >> reporter: we are back here live. you're looking again at police in riot gear waiting for protesters to potentially show up. a very odd scene. you may notice there's been a christmas wreath lighted up out here. perhaps city is thinking they will put this wrest up once they have cleaned out the plaza, perhaps a sign of what they hope

will be smoother times ahead. now, i have with me now one of the organizers of occupy oakland with us. he's spent many nights out there in the tent city, and you actually helped plan this march. tell me what you're thinking, where they are heading. were planning on coming here but what's going on? >> what happened is we hit police down there on 12th, and we went the opposite way. we went down broadway, down towards the foot of broadway, and that's the last i've seen. i came back here. the issue of this demonstration is that people are furious. that is demonstration of working people, of school teachers and others who in the middle class who are suffering from our economic situation the way it is, and we were peaceful protesters here, and we are absolutely shocked that the city would use such incredible force. police from ten different places, as far away as san jose,

and bringing in armored personnel careers and using gas against a peaceful protest, and so what we're going to see here is just like in new york, just like you see in in this demonstration. that was supposed to be a small planning group that exploded into well over a thousand people, and it's going to get much, much bigger now, just like it did in new york city. >> reporter: what do you predict for tonight? do you think they will come back and try to reclaim this plaza? >> i think it would be a little bit foolish with the barricades and what the police have shown that they are willing to do for people to come back here to this plaza right now. many of our people are in jail now. they are not cited and released for misdemeanors. keeping people in jail, indefinitely, at least until thursday and charging outrageous bail that nobody can afford. >> reporter: thank you very much. again, those protesters are on the move. they are on the march as we

speak. they are down by police headquarters. we're not certain if they will make their way up here, but, again, hearing that perhaps they will not see the police presence, the heavy police presence surrounding the plaza tonight. reporting live in oakland, i'm jodi hernandez, nbc bay area news. >> again, that plaza now barricaded by police and cleanup and sanitation issues being dealt w.meanwhile, across the part of town, protesters are on the move. they were headed to the police headquarters to try and figure out exactly what they are doing. have some sort of a confrontation with police. police are continuing to keep them moving. protesters fanning out across the streets. still organized and still moving and at this point still unclear as to where they might be headed. >> 80 protesters were headed this morning in that interview. they were saying that the occupy protesters, there's a lot of force this morning. there wasn't oakland police. oakland police got the help from several local agents, other police departments and even the santa clara county sheriff's department who was on site right now as we speak helping with

it was a whirlwind visit to the bay area, president obama here long enough to raise some cash at a campaign fund-raiser in san francisco and while mr. obama was collecting green, advocates of another type of green were making their voices heard. nbc bay area's tracy grant is live in san francisco where protesters say a federal crackdown on pot may cost them some obama supporters. >> reporter: well, jessica, some of these protesters today had some marijuana in one hand and anti-obama signs in the other. now their point was that medical marijuana to some people might seem like a life or death issue and an issue many thought they wouldn't be fighting about once obama took office. >> they sent a letter to our landlord threatening them with property forfeiture, of fines and imprisonment if we were not

evicted. >> reporter: that's how reverend randy webster's medical marijuana dispensary got shut down. webster says san francisco patients cooperative had to close its doors back in 2008 because she and other dispensary operato or operators, as well as property owners, were being harassed by the department of justice. >> they felt completely helpless, and they were not given any support. >> reporter: webster thought putting obama in office would make a difference, but now medical marijuana advocates say it's happening all over again. that's why protested gathered outside the "w" hotel today, waiting for president obama to arrive for a fund-raiser. they were here to inform the president that he went back on his word, and he may lose supporters because of it. >> i'm a registered democrat, right? i will not vote for obama. >> reporter: here's the problem. on the campaign trail obama promised to stop the federal government's war on medical marijuana, and then once elected his administration said prosecuting marijuana providers who weren't breaking state laws

wasn't an efficient use of federal resources, but this month the department of justice started making the same kind of threats as in 2008, and the irs has joined in, demanding additional tax money. >> what the feds are being permitted to do is an atrocity. >> yes. >> and the fact that president obama has gone against his promise to us indicates to me just how deep his level of hypocrisy truly goes. >> reporter: president made it inside the hotel with very few of these protesters even seeing his car arrive which means he probably didn't see them either. clint werner still thinks this protest will make an impact. >> he's isolated, insulated from a lot of things, but i think what it does is it gives us a voice. >> reporter: now back in 2008 when san francisco patients cooperative went down a lot of other dispensaries, went down with it, that's what some people fear is going to happen this time, that the department of justice is just going to pick

off one dispensary after another. live in san francisco, tracy grant, nbc "bay area news." >> thanks, tracy, back to our breaking news in downtown oakland. you're seeing our nbc chopper above the scene. this is many of the occupy protesters who were dismantled from their camp this morning. they are now marching towards city hall once again tonight. this is near eighth and washington. you see a heavy presence of oakland police. here's an update near eighth and washington. cheryl hurd told us five minutes ago that police declared an unlawful assembly and within the last five minutes there's been reports of police firing rubber bullets, non-lethal rubber bullets towards the crowd to help disperse the crowd. we'll tell you more about this throughout the night leading to our 11:00 forecast. >> let's turn things over to jeff ranieri now to talk about the change in the forecast. jeff? >> looking at drying winds being the biggest change over the last 24 hours.

a red flag fire washing now in place for parts of the bay area. inters of the highs today, cooling here with the onshore flow and fog this morning. dropped down to 73 in livermore, 70 in gilroy and 37 in los gatos and 64 in san francisco with 69 in san rafael. so about 20 to 30 degrees difference from what we had this weekend. right now out in the south bay we currently have a little bit of haze as you look across downtown and winds out the northwest at 14. the swand drying wind, dropping our humidity levels. normally that would heat us up quite a bit across the bay area and so much cool air aloft it's really having an impact on the temperatures. however, it has increased, the fire danger, northwesterly wind. some of the air across the north bay with 50s in livermore and san jose. we'll be under one of the coldest nights we've had in months as we head to tomorrow morning. let's take a look. developing dry winds because we have two weather systems

competing against each other. we have cold air across the four corners and then this milder air here out in the west and when you get two weather systems this close it helps to create the wind. for us we're finding most of that wind across our higher elevation with these humidity levels that will drop to about 20% as we head into tomorrow. so, it's red flag fire warning in effect through thursday morning for the hill top of the north bay where winds will be about 15 to 30 miles per hour. you can see it's not gusting too much right now, even in the east bay, but once again, as we head throughout tomorrow, that's when the winds do look to peak here and the fire danger is at its higher. tomorrow morning, talked about one of the coldest nights possibly in months for some of you. look at the numbers. 6:00 a.m. tomorrow, 46 in santa row,a and 49 in livermore. you'll need the jacket as you get ready tomorrow. get the kids ready for school and get yourself ready to head out the door. only low 60. more in your seven-day forecast, including yes an early peek into halloween which is next monday,

guys. >> thank you. >> want to take you back to the scene of your live shot here. it's a chopner oakland and you can see a phalanx of police officers shoulder to shoulder with batons, and they are waiting and you can see protesters lining up almost directly in front of them. at this point they are not moving. we had heard some were trying to make it back to the plaza which is completely barricaded. we are getting some reports that now some of the protesters may actually be moving some of those barricades. whether it's because they want to enter the protests area where they had their encampment before or they want to create their own barricaded area, we're not really sure of. also been hearing about a few skirmishes with police engaging with some flash grenades and some rubber bullets, but at this point it looks like there may be a standoff between the police officers, that themem too a d danx, moving em to a differeif area. we'll continue to monitor the ork.sheabrbut now we take a california should be proud.

to worry about. that technology was designed here inside a company that's quietly grown to 100 people with lots of jobs still open. think of it as a green tech product that wants took from this to an object of desire. >> today it's essentially white plastic bottles. consumers are used to amazing experiences like the iphone and ipad and we want to bring that to the thermostat. >> the thermostat costs $250, about what the company claims you'll save on your energy bill in a year if you use it, and, yes, there's even an app to control it remotely. it may not seem as sexy as the ipod at first glance but it is different and saving money is always in style. the thermostat is on sale. as of today, the company plans to start shipping them early next month. what do you think, $250, is it worth an upgrade to your wall? >> all right. thank you for that.

have to think about that one. >> okay. one quick check now on our breaking news, developing news now. nbc chopner downtown oakland. this appears to be right at 14th and broadway which is right across the street now from oakland city hall and the plaza. the occupy protesters who were driven out of their encampment early this morning are now back. you see a long line there of oakland police, and mott just oakland police. a lot of police departments helping coordinate with this tonight from across the bay area. police in riot gear care cading essentially the plaza. our nbc chopper right above the scene. cheryl hurd says it is peaceful as of right now. check back with her and our reporters on the ground level next right after this.

plza that has now been barricaded by police while sanitation workers are inside cleaning it up. some of the protesters have returned to their area bringing their own barricades. our own jodi hernandez is on the ground to let us know exactly what's happening. jodi? >> reporter: jess characters the protesters arrived here just a short time ago chanting this is our street, our street. the barricades came down, and there seemed to be kind of a scuffle with the police. you can see the police are lined up in their riot gear, and immediately the police got on a loudspeaker warning the folks that they were unlawfully assembled and ordering them to move immediately or risk arrest and serious injury. now, just within the last couple of minutes the crowd has kind of cleared this intersection here. they are heading kind of on the outer edge of the plaza, but we understand that things were getting kind of ugly just up the street here. i'm going to bring in james

lamb, you are marching with the protesters. what did you see and experience? >> basically when i was at eighth and washington street downtown oakland, there was some commotion, and the police ended up firing, both flash grenades, and there was a lot of noise of shooting. people are saying it's rubber bullets or beanbags, also tear gas. a lot of people running and i hadn't heard an announcement from where i was and there was a lot of people around, a lot of women and children. a lot of women didn't know what was going on. kind of a violent point. >> peaceful up to that point? >> nothing except the regular protest sneers what what are you surprised to learn? >> the level of repression and violence from the police and city, democratic progressive city like oakland, i'm really shocked to see this. >> reporter: thank you very much. that's james lamb. again, the protesters appear to

have cleared this area. they are moving around the plaza. the police, as you can see, are still lined up here with their full riot gear. i can tell you just within the last couple of minutes that the feeling that emotions have died down a bit. getting a little against just a shored time ago. we haven't seen any rubber bullets or tear gas though the police issued a strong warning to this group, that if they remain here, they do risk arrest and seerouts injury. >> while we still have you, jodi. what's the plan? do you know? do they plan on spending the night once again and re-establish their camp that was broken up this morning. >> it's a very fluid situation. we talked earlier to another organization so i think they are taking is, ringing it.

they had marched down fords the police department and now they are back here at the plaz a. it's a mixed crowd. it seems like every people out here and they want to get involved in any kind of call or risk injury. a lot of people seem to be dispersing now and listening to the warnings from police. we don't know what the plan s.i don't think there's any plan. >> for a couple of weeks oakland mayor jean cahn said she was supporting the movement. this is now becoming for headlines. new at 6:00, the hell's angels saga continues to unfold. an oakland man is charged with running down the man. he includes a number of felony

charges including hurd ant hull who prosecutors say intentionally collided on eastbound 580 near grand avenue. hall is accused of running down the victim on a motorcycle and dragging the bike for a mile. san leandro police say the suspect attempted to run from the scene before he was arrested. hall is the driver for east bay paratransit. the pregnant woman killed of killing east bay nursing student michelle li was back in court tase asking the judge for permission to fire her current attorney and be assigned a new court-appointed lawyer, but today a judge denied her request. the hearing was postponed. a court date has been set for early december. >> a man wanted for at least four burglary charges pled

guilty today. jean is linked to four bank robberies in san francisco, the most recent on october 6th. nkba wked into the bank, showed a note demanding money from the teller. he'll be back in court at the end of november p ge & e is making repairs to a gas line that broke just before 3:00 in san jose in an area not far from the airport. the leak is not a threat. turns out a construction crew hit a construction line while digging north of montague. structure workers in the area were evacuated as a precaution but roads near the scene are reopened. traffic, we have to tell you, is a little bit slow. >> 880 most notorious freeways and delays and digits to repair

the aging freeway. >> a lot of heavy roads going through this freeway, you know. >> reporter: a trip to the gas station gave ruehl a brief respite from his ride on 880 today. >> if you're driving on an old truck like this one, you get a lot of bumps, you know, jump a lot. you can will be hit your head on the roof. >> 20 years behind the real, you've had plenty of head to cap experience. >> all the lows and everything, it's going to do 60 plus years of wear and tear have indeed taken their toll on 880. the roadway struck up. >> at the end of its useful life, it's not its job. it's time for us to be rhett fitted and replaced. >> but a smoother ride is just

ahead. caltrans is two years into a four-year project to replace a 50 mile stretch. work on the fifth avenue of the rhett fit portion is one of eight projects under way. >> we're investing over $200 million on this project. to rhett fit to bring in safety to the tune of over 200,000 traveling public that traveled over this. many bridges were built during the depression. senator barbara boxer who toured the fifth avenue structure said the state of california has to step up. >> some of our infrastructure is very, very old and we can't just cross our finger. we need to be taking action. >> reporter: next week congress will consider president obama's proposal to raise billions of dollars for transportation programs with a tax on millionaires, but similar proposals have already faced fierce opposition.

>> you've got to make is t safer. >> reporter: this man is among those who don't want to see delays as he heads off for another day at t office. joe rosoto, jr., nbc bay area news. >> want to take you back to the scene in oakland right now. as you mentioned, just a short time ago. protesters have made it to the plaza again, but were turned away from police. we understand they are walking down broadway and heading towards telegraph so they are on the west side of lake merritt not far from the b.a.r.t. station there. they continue to move and then there's some pockets where the protesters stop and end up in skirmishes with police. we don't know if the intention is to head to the theater but they are heading in the general direction from broadway to telegraph. it's unclear at this point if there's a designated location where they are headed. one thing is clear though, they have been turned away from the

a lot of tails are wagging in alameda tonight. a new agreement will allow the city's animal shelter to remain open. today's deal between city officials and local volunteers calls for the city to provide their 300,000 annually to the friends of alameda animal center. this spring city officials announced the shelter may close due it a projected $14 million bucket deficit. a volunteer group will step up beginning in january, just a few months from now, to handle the general upkeep of the facility. the arrangement will be in effect for 15 years and could still be extended. >> well, the monterey bay aquarium released its sixth great white shark back into the wild today. today released near santa barbara early this afternoon after being at the aquarium for 55 days.
